DMCA & Intellectual Property Protection
At Koinoniabyzazel, we take intellectual property rights seriously. Our platform empowers users to create and sell custom-designed merchandise — but never at the expense of someone else’s creative rights. All sellers on Koinoniabyzazel agree to refrain from using or uploading materials that infringe copyrights, trademarks, or other intellectual property protections.
If you believe that your intellectual property has been misused or infringed by a seller on our platform, we encourage you to notify us following the process below.
A. How to Report a Violation
It is our policy to:
Remove or restrict access to any content that we believe, in good faith, violates the intellectual property rights of others upon receiving a proper takedown notice.
Take appropriate action against repeat offenders, which may include termination of accounts.
To submit a valid infringement notice, please include the following:
A clear description of the copyrighted work or IP you believe has been infringed, along with any registration details (if applicable).
A specific description of the content you’re reporting, including how it violates your rights and where it’s located on Koinoniabyzazel.
Your contact information (full name, mailing address, phone number, and email).
A statement affirming that you believe in good faith that the use is unauthorized.
A declaration under penalty of perjury that the information you’re providing is accurate, and that you are the rightful owner or legally authorized to act on the owner’s behalf.
Your physical or digital signature.
B. What Happens Next
Once we receive a properly formatted notice:
We will remove or disable access to the reported content.
We will notify the seller or user responsible for that content.
In cases of repeat infringement, we may suspend or permanently terminate the user’s access to Koinoniabyzazel.
C. Submitting a Counter-Notice
If you believe the content removed or restricted was done so in error — for example, due to misidentification or a valid fair use — you may file a counter-notification. Your counter-notice should include:
Identification of the content that was removed or disabled, with details about its original location on Koinoniabyzazel.
A sworn statement, under penalty of perjury, that you believe the removal was a mistake or misidentification.
Your name, mailing address, phone number, and email.
A statement that you consent to the jurisdiction of a U.S. Federal Court in your district (or where Koinoniabyzazel is based if outside the U.S.) and will accept service of process from the original complainant.
Your signature, digital or physical.
Upon receipt of a valid counter-notice, Koinoniabyzazel may notify the original party who filed the complaint. Unless they initiate legal action within 10 business days, we may restore the removed content at our discretion within 10–14 business days or more.
Important Note:
Under Section 512(f) of the DMCA, anyone who knowingly misrepresents infringement claims or counterclaims may be held liable for damages — including legal fees.
